Welcome to Ultimate Selfie. By downloading, installing, accessing, or using the Ultimate Selfie mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User") and Ultimate Selfie ("Company," "we," "us," or "our"). These Terms govern your access to and use of the App and its artificial intelligence-based image generation services.

2. Description of Service

Ultimate Selfie utilizes Artificial Intelligence (AI) to generate, modify, and enhance images based on user inputs and uploaded photos. You understand that the Service relies on evolving AI technology and results may vary.

3. Virtual Credits and Purchases

A. No Monetary Value

The App uses a virtual currency ("Credits") to perform certain actions (e.g., generating images, using "Beast Mode"). Credits have no real-world monetary value, cannot be exchanged for cash, and are non-transferable.

B. Loss of Credits

You expressly agree that we are not liable for any loss of Credits.

Credits are consumed at the moment a request is sent to our servers. We are not responsible and will not offer refunds or replacements for Credits lost due to:

Internet connectivity issues, network interruptions, or weak signals on your device.
App crashes, freezes, or unexpected closures during processing.
Server latency, timeouts, or downtime.
Uninstallation of the App (which may permanently erase local data).
Dissatisfaction with the AI-generated result.

C. No Refunds

All purchases of Credits through the Google Play Store are final. We do not provide refunds for unused Credits or for Credits lost due to technical issues outside our direct control.

4. AI Generation and Content

A. Nature of AI

You acknowledge that the App uses generative AI, which is probabilistic and experimental. We do not guarantee the quality, accuracy, realism, or suitability of any generated image. The AI may produce artifacts, distortions, or unexpected results.

B. No Liability for Content

We are not responsible for the content of the images generated.

You acknowledge that the AI may inadvertently generate content that is offensive, inaccurate, or inappropriate. You agree that Ultimate Selfie is not liable for any psychological distress, reputational damage, or other harm resulting from the viewing or sharing of generated images.

C. User Responsibility

You are solely responsible for the images you upload and the prompts you enter. You agree not to use the App to generate:

Child sexual abuse material (CSAM).
Non-consensual sexual content (deepfakes).
Hate speech, violence, or harassment.
Content that infringes on the intellectual property or privacy rights of others.

5. Indemnification

This is a material condition of your use of the App.

You agree to indemnify, defend, and hold harmless Ultimate Selfie, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from:

Your use or misuse of the App.
Your violation of these Terms.
Your violation of any rights of any other person or entity (including privacy and intellectual property rights).
Any content generated by you using the App.
Any loss of data or Credits due to technical failures.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ULTIMATE SELFIE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP;
(C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts of Cebu City, Philippines.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
